Legal basis for the system of energy performance certification in Poland:


Act of  19 September 2007 changing the Construction Law (Journal of Laws no. 191 of 18 October 2007, item 1371)

  • Ordinance concerning training and examination of experts to issue energy performance certificates for buildings. (Journal of Laws no. 17 of 31 January 2008, item 104) 

  • Ordinance concerning methodology of calculation of the energy performance of buildings and apartments and the method of preparing and template for EP certificates (Journal of Laws no. 201 of 13 November 2008, item 1240)

and the amendment to the 2008 Act recently (16 July 2009) passed by the Lower House of the Parliament

When ?

According to the Law, energy performance certificates are required for:

  • new buildings

  • existing buildings when sold or rented.

Moreover, the Act requires that a new certificate is issued when the old one expires (10 years from its issuing) or when energy performance is altered due to redevelopment or renovation of the building (this applies to thermomodernization).


The owner of the building should ensure that the energy performance certificate is issued and make it available for the buyer or tenant of the building or apartment.


Special requirements apply to buildings with total useful floor area over 1000 m2 that are occupied by public authorities and buildings frequently visited by the public like train stations, airports, museums, exposition halls. In these buildings energy certificates should be clearly displayed to educate the society and promote energy efficiency.
